OK, then by the same line of thinking, the ground that was torn up by the previous golfer could also be assessed as ground under repair as well. Very similar scenerios but you think one is unfair or incorrect and the other isn't. Personally I don't mind either and if given the choice would much rather have the sand filled divot. At least you're not hitting below the surface of your stance and having to adjust for it.
